Probate

If you die in Oklahoma with or without a will, your estate will need to be probated. Probate literally means "proving the will." Generally, the probate process involves bringing the decedent's original will to be declared the original will by a court of law. Then, the executor is appointed, who collects the assets of the estate, submits a list of assets to the court, then distributes the assets pursuant to the terms of the will. All of this must be accomplished with court supervision and approval. The executor must also file an estate tax return with the Oklahoma Tax Commission and IRS and pay any estate taxes due.
